Fort Erie man accused of impaired driving twice in one day: NRPS

The 39-year-old faces multiple charges as a result

On Feb. 25, 2021, at approximately 10:30am a member of the public contacted the Niagara Regional Police Service (NRPS) to report a possible impaired driver in the Town of Fort Erie.

5 District – Fort Erie uniform officers and Niagara EMS paramedics responded to a parking lot in the area of Garrison Road and Concession Road.  Officers and paramedics found a lone man in the driver’s seat of a parked, running grey Ford Fusion. The man displayed physical signs of alleged impairment and was arrested.  The man was transported to a local hospital for medical assessment. After receiving medical care and upon sobriety, the man was transported by officers to his Fort Erie home where at approximately 3:30 p.m. he was released from custody with a future court date.

On Feb. 25, 2021, at approximately 8:20pm a member of the public contacted the NRPS to report a possible impaired driver in the City of Port Colborne. 6 District – Port Colborne uniform officers responded to the area Fares Street and Nickel Street. The Ford Fiesta was reportedly travelling at approximately 10km/hr and was swerving on the roadway.

Officers located and stopped the Ford. The driver was alone in the Ford. In talking to the driver the officers observed signs of impairment. The driver was placed under arrested for impaired operation of a car. The driver was transported to the NRPS Prisoner Management Unit in the City of Niagara Falls. 

Matthew James Robert Graham (39 years old) of Fort Erie has been arrested and charged with the offences of:

Fort Erie Incident #2021-16738 

  • Impaired operation of a conveyance by drugs S.320.14(1)(a) C.C. 
  • Fail to comply with probation order S.733.1 C.C. 

Port Colborne Incident #2021-16955 

  • Impaired operation of a conveyance by drugs S.320.14(1)(a) C.C. 
  • Fail to comply with probation order S.733.1 C.C. 
  • Driver fail to surrender licence S.33(1) HTA 
  • Fail to surrender permit for motor vehicle S.7(5)(a) HTA 
  • Fail to surrender insurance card S. 3(1) CAIA

Graham was held in custody for a bail hearing. He will attend a video bail hearing to the Robert S. K. Welch Court house on Feb. 26, 2021. 

Graham has been issued an Administrative Driver's Licence Suspension (ADLS). The ADLS, is issued to everyone charged with similar driving offences. The ADLS prohibits the recipient from operating a motor vehicle for 90 days from date it was issued.
